The short version

These Terms of Service (“Terms”) are a binding agreement between you and Scan My Taxes LLC (“ScanMyTaxes,” “we,” “us,” or “our”) governing your use of our website, tools, and services at scanmytaxes.com (together, the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.

2. What the Service is — and what it is not

ScanMyTaxes helps you identify tax strategies and deductions that may apply to your situation and produces general, illustrative estimates based on the information you provide and on assumptions built into the tool.

The Service is for general educational and informational purposes only. It is not tax, legal, accounting, or financial advice; it is not a tax return, tax filing, or tax preparation service; and it does not create an accountant-client, attorney-client, preparer, fiduciary, or other professional relationship between you and ScanMyTaxes. We are not a certified public accountant, enrolled agent, attorney, or registered investment adviser, and no one at ScanMyTaxes is acting in that capacity toward you. You are responsible for your own tax positions and filings. Always consult a qualified tax professional before acting on any information, estimate, or strategy from the Service.

Any statement that our content is “reviewed by a CPA” or “CPA-reviewed” means the educational material has been reviewed for general accuracy by a licensed CPA. That review is of the general educational content only; it is not individualized tax advice to you, is not a review of your specific situation, and does not create a CPA-client relationship between you and that CPA or ScanMyTaxes.

3. Estimates, accuracy, and your responsibility

All figures the Service produces are estimates, generated from the inputs you give and from general assumptions and current understanding of tax rules, which change. Estimates may not reflect your full situation and are not a promise or guarantee of any deduction, credit, refund, tax saving, or outcome. Your actual results depend on your complete facts, applicable law, and how your return is prepared and filed. You are solely responsible for verifying any strategy or number with a qualified professional and for the accuracy of the information you enter.

4. How the tool handles your data

The scan runs in your browser. Your tax return and its specific dollar amounts stay on your device and are never uploaded to us. The limited information we do receive, and how we use it, is described in our Privacy Policy, which is incorporated into these Terms.

5. Accounts

Some features (such as the agent portal) require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly at support@scanmytaxes.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

6. Subscriptions, automatic renewal, billing, and cancellation

Some parts of the Service are offered as paid subscriptions. The following terms apply to any subscription you purchase. We also present the key terms to you clearly and conspicuously at checkout, next to where you agree to pay, and obtain your affirmative consent there.

We keep a record of the terms you were shown and your consent to them, as required by applicable automatic-renewal laws.

7. Acceptable use

You agree not to: use the Service for anything unlawful; scrape, copy, resell, or reverse-engineer the Service; interfere with or disrupt it; attempt to access data that is not yours; upload malicious code; or use the Service to provide tax-preparation or advisory services to third parties without our written permission.

8. Intellectual property

The Service, including its content, software, calculators, worksheets, and branding, is owned by ScanMyTaxes and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own tax planning. The report and worksheets are for your personal use and use with your own advisor. Any downloadable content is provided for that purpose only.

9. Third-party services and links

The Service may link to or rely on third-party services (for example, our payment processor and email provider). We are not responsible for third-party services or content, and your use of them is governed by their terms.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, UNINTERRUPTED, OR ERROR-FREE, OR THAT ANY ESTIMATE, STRATEGY, OR RESULT WILL BE ACHIEVED. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCANMYTAXES AND ITS OWNERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST SAVINGS, LOST DATA, TAX PENALTIES, INTEREST, OR ADDITIONAL TAX, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless ScanMyTaxes from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Dispute resolution — arbitration and class-action waiver

Please read this section carefully; it affects how disputes are resolved. Except for small-claims matters and requests for injunctive relief, you and ScanMyTaxes agree to resolve any dispute relating to the Service through binding individual arbitration, administered by [a named arbitration provider, e.g., the American Arbitration Association] under its consumer rules, rather than in court. You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including Sections 2, 3, 10, 11, 12, 13, and 14) will survive.

17. Miscellaneous

These Terms, together with the Privacy Policy and any checkout disclosures, are the entire agreement between you and ScanMyTaxes regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
